Refund and Cancellation Policy

1. Overview

This Refund and Cancellation Policy ("Policy") governs the cancellation and refund procedures for subscriptions to KudoScan ("the Service"). By subscribing to our Service, you agree to the terms outlined in this Policy.

This Policy is compliant with the Consumer Protection Act, 2019, the Reserve Bank of India (RBI) guidelines for payment processing, and other applicable Indian consumer protection laws. As a consumer, you have certain rights and protections under Indian law.

2. Subscription Cancellation

2.1 How to Cancel

You may cancel your subscription at any time through:

  • Using the cancellation option in your account settings

2.2 Cancellation Timing

When you cancel your subscription:

  • Your subscription will remain active until the end of your current billing period
  • You will continue to have access to all premium features until the subscription expires
  • No further charges will be made after the current billing period ends
  • Your subscription will not automatically renew
  • You will receive email confirmation of the cancellation

2.3 Immediate Cancellation

If you wish to cancel immediately and stop service access, you may contact our support team. However, you will not be entitled to a refund for the unused portion of your current billing period unless otherwise specified in this Policy or required by Indian consumer protection laws.

3. Refund Policy

3.1 Refund Eligibility

Refunds may be available under the following circumstances, in compliance with the Consumer Protection Act, 2019:

  • Within 7 Days of Initial Subscription (Cooling-Off Period): Full refund available if you cancel within 7 days of your first subscription payment, as per Indian consumer protection standards
  • Service Failure: Refund available if we are unable to provide the Service due to technical issues on our end or breach of contract
  • Billing Errors: Refund for duplicate charges, billing mistakes, or unauthorized transactions
  • Unauthorized Charges: Refund for charges made without your authorization, subject to verification
  • Defective Service: Refund if the Service does not meet the specifications as described or is materially defective

3.2 Non-Refundable Items

The following are generally not eligible for refunds, subject to your rights under the Consumer Protection Act, 2019:

  • Subscriptions cancelled after 7 days from the initial payment (unless service is defective)
  • Partial refunds for unused portions of a billing period (except as specified above or required by law)
  • Charges for services already used or consumed
  • Refunds requested due to violation of our Terms of Service
  • Refunds for promotional or discounted subscriptions unless explicitly stated or required by law
  • Refunds for services where you have received substantial benefit from the Service

3.3 Refund Processing

If you are eligible for a refund:

  • Refunds will be processed to the original payment method used for the subscription, in compliance with RBI guidelines
  • Processing time may take 5-10 business days depending on your payment provider and banking institution
  • You will receive email confirmation once the refund has been processed
  • Refunds are processed through Razorpay, our RBI-licensed payment processor
  • All refunds will be processed in Indian Rupees (INR) as per the original transaction
  • Any applicable taxes (GST) will be refunded proportionally as per Indian tax laws

4. Subscription Changes

4.1 Plan Upgrades

When you upgrade to a higher-tier plan:

  • The upgrade takes effect immediately
  • You will be charged the prorated difference for the remainder of your current billing period
  • Your next billing cycle will reflect the new plan's full price
  • All charges are inclusive of applicable GST as per Indian tax laws

4.2 Plan Downgrades

When you downgrade to a lower-tier plan:

  • The downgrade takes effect at the end of your current billing period
  • You will continue to have access to your current plan's features until the period ends
  • No refunds are provided for downgrades, but you will be charged the lower amount in the next billing cycle
  • Your next billing cycle will reflect the new plan's price

5. Payment Issues and Disputes

5.1 Failed Payments

If a payment fails:

  • We will attempt to retry the payment according to our payment processor's policies and RBI guidelines
  • You will be notified via email and SMS (if available) about the failed payment
  • Your subscription may be suspended until payment is successfully processed
  • You can update your payment method in your account settings
  • We will provide a grace period as per industry standards before suspending services

5.2 Chargebacks and Disputes

If you initiate a chargeback through your bank or credit card company:

  • Your account will be immediately suspended pending resolution
  • We reserve the right to dispute the chargeback with supporting documentation as per RBI guidelines
  • If the chargeback is resolved in our favor, you may be required to pay the original amount plus any associated fees
  • Repeated chargebacks may result in permanent account termination
  • You may also file a complaint with the appropriate consumer forum under the Consumer Protection Act, 2019

6. Free Trial Period

If we offer a free trial period:

  • You may cancel during the trial period without any charges
  • If you do not cancel before the trial ends, you will be automatically charged for the subscription
  • No refunds are provided for charges made after a free trial period ends, unless the service is defective
  • Trial terms and duration are subject to change with prior notice
  • You will be notified before the trial period ends and before any charges are made

7. Special Circumstances

7.1 Service Discontinuation

If we discontinue the Service:

  • We will provide at least 30 days' notice to all subscribers via email
  • Prorated refunds will be provided for unused subscription periods
  • You will have the opportunity to export your data before service termination
  • Refunds will be processed within 15 days of service discontinuation

7.2 Account Termination by Us

If we terminate your account due to violation of our Terms of Service:

  • No refunds will be provided unless required by law
  • Access to the Service will be immediately revoked
  • You may appeal the termination by contacting our support team or Grievance Officer
  • You have the right to seek redressal through consumer forums if you believe the termination was unfair

8. Consumer Rights Under Consumer Protection Act, 2019

As a consumer under the Consumer Protection Act, 2019, you have the following rights:

  • Right to be Protected: Against unfair trade practices and restrictive trade practices
  • Right to be Informed: About the quality, quantity, potency, purity, standard, and price of services
  • Right to Choose: To be assured access to a variety of services at competitive prices
  • Right to be Heard: To be assured that consumer interests will receive due consideration
  • Right to Seek Redressal: Against unfair trade practices or restrictive trade practices
  • Right to Consumer Education: To acquire knowledge and skills to be an informed consumer

You may file a complaint with the appropriate consumer forum (District/State/National Commission) if you believe your consumer rights have been violated.

9. Requesting a Refund

To request a refund, please:

  2. Include your account email and subscription details
  3. Provide a clear reason for the refund request
  4. Include any relevant documentation or evidence
  5. Mention the transaction ID and payment details

We will review your request and respond within 5-7 business days. Approved refunds will be processed within 5-10 business days as per RBI guidelines. If your refund request is denied, we will provide a clear explanation for the denial.

10. Grievance Redressal

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection Act, 2019, we have appointed a Grievance Officer to address your concerns:

11. Changes to This Policy

We reserve the right to modify this Refund and Cancellation Policy at any time, subject to compliance with Indian consumer protection laws. Material changes will be communicated via email or through the Service at least 7 days in advance. Your continued use of the Service after such modifications constitutes acceptance of the updated Policy. If you do not agree to the modified Policy, you may cancel your subscription.
